Please read carefully the General Conditions of Sale and the General Conditions of Use of the us.sanajardin.com website.

1. GENERAL
The following terms and conditions shall apply to all sales of SANA JARDIN products (the “Products”) that you (the “End Customer” or “you”) may order from SANA JARDIN (UK) LIMITED, a UK limited company, having its registered office located at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, registered with the Registrar of Companies for England and Wales under No 10840196 (“SANA JARDIN” or referred to herein as “us”, “our” or “we”) either (a) by email (via customercare@sanajardin.com) via the customer contact centre of SANA JARDIN (the “Customer Service Centre”) or (b) on the Internet via SANA JARDIN’s Website, identified by the domain name "us.sanajardin.com" (the "Website").


These Conditions of Sale exclusively apply to sales made through the Customer Service Centre or the Website. Sales conducted through SANA JARDIN shop-in-shops or authorized SANA JARDIN dealers are not subject to these Conditions of Sale.

SANA JARDIN may modify the Conditions of Sale from time to time, at its sole discretion. The Conditions of Sale applicable to any order placed through the Customer Service Centre or the Website are those in force at the time that an order has been placed on your behalf by a representative of SANA JARDIN (when the order is placed through the Customer Service Centre) or at the time you place your order (in the case of an order placed through the Website).

In the case of an order placed through the Website, when you check the “I Accept” box at the order confirmation section of the Website before placing your order with SANA JARDIN, you indicate your acknowledgment and full acceptance of these Conditions of Sale.

For orders placed through the Customer Service Centre, the applicable Conditions of Sales applicable to your order will be sent to you by email if you have given this information as mentioned in articles 5 and 10.

In any case (and in particular for orders placed through the Customer Service and for which we do not have your email address) the main provisions of these Conditions of Sale will be attached to your invoice. If you refuse to accept these Conditions of Sale, you will not be able to order any SANA JARDIN products from the Website or the Customer Service Centre.

Persons wishing to use the Customer Service Centre or the Website will also be deemed, by virtue of such use, to have agreed to be bound by our Website Terms of Use and our Privacy Policy, which are incorporated to these Conditions of Sale by reference. Customers using the Customer Service Centre will be provided with access to our Privacy Policy as set forth in article 10 “Acknowledgment of your Order”.

2. PURCHASING ELIGIBILITY
Only individuals who (a) have reached the age of majority (eighteen), (b) have legal capacity to enter into contracts, and (c) are acting in a capacity that is unrelated to any business or professional activity may order Products through the Customer Service Centre or on the Website. If you are under the age of majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf. Any orders placed in contravention to this provision and any related contracts made on the basis of such orders shall be null and void.

By placing an order through the Customer Service Centre or on the Website, you represent and warrant that you are a bona fide end-user customer and will not deliver, sell or otherwise distribute the Products or purchase Products for commercial purposes or any other commercial benefit. If SANA JARDIN believes in its sole discretion that an order would be in breach of these Terms and Conditions, then SANA JARDIN may refuse such order.

3. NATURE OF ORDERS
Products presented on the Website are an invitation to tender an offer and are non-binding. The agreement shall become effective when the customer places an order (offer) and when SANA JARDIN then confirms the order (acceptance). There is no obligation on the part of SANA JARDIN to accept an order.

4. PRODUCT AVAILABILITY; QUANTITY
Our products and their prices are valid as they are displayed on the us.sanajardin.com website, subject to availability and acceptance by SANA JARDIN according to its free business decision. Instructions about the availability of products are provided at the time of the ordering. At times, errors may exist, especially in case of simultaneous orders of the same product by several customers.


SANA JARDIN reserves the right to change the assortment of Products proposed on the Website or through the Customer Service Centre.

Please also note that SANA JARDIN may refuse, terminate or cancel your order if SANA JARDIN suspects that you have engaged in fraudulent activities as mentioned in article 6.

The Customer Service Centre and the Product pages of the Website can provide you with information regarding Products that are currently presented for sale through those channels. Please note that only the Products displaying an “Add to Bag/Cart” button are available for sale through the Website and the Customer Service Centre. SANA JARDIN reserves the right to change from time to time the assortment of items offered on its product pages. You may also call the Customer Service Centre and an SANA JARDIN’ representative will provide you with further information as to Product availability and assist you with your purchase.

5. ACCOUNT REGISTRATION; PERSONAL INFORMATION
In order to place an order through the Customer Service Centre or on the Website, you or the SANA JARDIN representative (on your behalf) will be required to provide valid and up-to-date personal information, such as your full name, phone number and e-mail address.

Upon completion of your account registration on the Website, you will receive an email summarizing the personal information and a link to the “My Account” section of the Website, whereby you will be able to set or change your user name, password and personal information. You are responsible for ensuring that your password and account login are kept secret, safe and secure at all times. SANA JARDIN will not be held responsible or liable for any misuse of your account resulting from a third party’s access to and use of your password and account login.

We may change the information required to place a new order or the registration requirements from time to time. Please refer to our Privacy Policy and article 9 of these Conditions of Sale for more details about how we may use your personal information.

As to order placed through the Customer Service Centre, the SANA JARDIN’ representative (on your behalf) will be required to register valid and up-to-date personal information, such as your full name, phone number and e-mail address.

Should any of the information you provide to the Customer Service Centre or on the Website change, please login to your account and update such information directly on the Website or inform the Customer Service Centre or notify SANA JARDIN at the following e-mail address: customercare@sanajardin.com, or as set out in our Privacy Policy. Moreover, in the event that SANA JARDIN reasonably believes that your account is being misused or has been accessed by a third party, SANA JARDIN may cancel such account temporarily or permanently, terminate any activities on it and shall notify the same to you by email or telephone.

6. ORDERS
If you are ordering on the Website, orders will be processed as follows: once you have chosen a Product, click on the “Add to Cart” button to place this Product in your "Shopping Bag". You may then decide to continue shopping for other Products and add them to your shopping bag (subject to availability and quantity limits) or proceed to checkout by clicking on the “Proceed to Checkout” button. You may also remove one or several Products you have selected by clicking on "Remove" next to the chosen Product in the Shopping Bag.

When ordering by telephone through the Customer Service Centre, a SANA JARDIN representative will follow the order process on your behalf.

When placing an order through the Customer Service Centre or on the Website, you will be required to provide other personal information as applicable, such as shipping address, billing address and payment details. You warrant that all personal information given to SANA JARDIN is true and correct. SANA JARDIN or its third party providers may collect additional information at this time for security and anti-fraud purposes.

Notwithstanding anything to the contrary provided for herein, SANA JARDIN reserves the right to refuse, cancel and terminate orders at any moment in time. For example, SANA JARDIN may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if SANA JARDIN s suspects that you have engaged in fraudulent activities or have otherwise violated these Conditions of Sale.

7. PRICES, TAX AND DELIVERY COSTS
All prices shown on the Product pages of the Website or quoted by the Customer Service Centre are in British Pounds (GBP), including VAT as applicable in the United Kingdom, but not the delivery costs and any other taxes, unless stated otherwise.

When the goods are bought by a non-EU resident and delivered outside the EU, the final price is in British Pounds (GBP), excluding VAT as applicable in the United Kingdom.

The recipient of an international shipment outside the EU may be subject to import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country.

Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and can't predict what they may be.

Customs policies vary widely from country to country; you should contact your local customs office for more information.

The recipient is the importer of record and must comply with all laws and regulations of the destination country.

Your privacy is important to us and we know you care about how information about your order is used and shared. We'd like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

SANA JARDIN reserves the right to modify prices and delivery costs at any time without prior notice. The price of a Product and delivery costs displayed on the Website or quoted by the Customer Service Centre, as indicated at the time SANA JARDIN provides you with a Confirmation of Order, will be honoured by SANA JARDIN.

Actual delivery costs and applicable taxes will be reflected on your order page before you are asked to confirm and place your order (in the case of a Website order), or will be quoted by the Customer Service Centre (in the case of a telephone order), and will also appear on your Confirmation of Order and invoice. Delivery costs, if any, are described in the delivery policy set forth below.

Please note that in case of changes to the applicable taxes rates between the date your order is placed and the date SANA JARDIN is ready to ship your order, we will contact you and ask you to reconfirm your order. If SANA JARDIN cannot obtain your instructions, SANA JARDIN will cancel the order and notify you of such cancellation.

8. REVIEW AND CONFIRMATION BY CUSTOMER
Our Website ordering process allows you to check and amend any errors in your order before submitting your order to us. You should carefully check all details before placing your order on the Website, including without limitation the particulars of each sale, which will be provided by the SANA JARDIN representative (in the case of an order being placed through the Customer Service Centre) or the Website (in the case of an order being placed through the Website).

When you have completely reviewed your offer to purchase, check the box next to “By checking this box I hereby certify having read the Terms of Sales of the website us.sanajardin.com and I accept them” to indicate your agreement to be bound by these Conditions of Sale, and then click on the "Place order" button on the Website to place your order.


By placing an order through the Website, you are submitting an offer to SANA JARDIN to buy the Products you have placed in your “Shopping Bag”.

9. PAYMENT METHODS
SANA JARDIN accepts the following payment methods: Visa, MasterCard and American Express credit cards and through the PayPal platform. We also accept international Visa, MasterCard and American Express credit cards from selected countries.

When ordering on the Website, you will need to enter your payment details on the appropriate form. If you order by telephone, you will need to communicate to the Customer Service Centre your payment card number and your three digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID). Your telephone conversation may be monitored or recorded for security reasons or quality assurance purposes. SANA JARDIN will never otherwise store your payment card number and your three- or four- digit security code. Please refer to our Privacy Policy for more details about how and how long we may use or keep your personal information and the conversation recordings.

All payment card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to SANA JARDIN, you will need to contact your card issuer directly to solve this problem, and SANA JARDIN will not be liable for any delay or non-delivery.

In order to process your order, we may perform a pre-authorization of your payment card. The amount of your purchase will be blocked on your payment card until your order is shipped to the delivery address you have provided to SANA JARDIN, at which time you will be sent a Confirmation of Order and your payment card will be charged the applicable purchase price. By submitting an offer to purchase the Products on the Website or through the Customer Service Centre, you expressly authorize SANA JARDIN to perform such payment card pre-authorization and, where SANA JARDIN deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your payment card number, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

SANA JARDIN takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. SANA JARDIN uses Secure Sockets Layer (SSL) encryption only during the order process and on your account page where personal information is collected. Unfortunately, transmitting information over the Internet is not completely secure.

Although we take all reasonable measures to protect your personal Information throughout the on-line selling process, we cannot guarantee the integrity and security of the data you transmit to the Website and SANA JARDIN cannot be held liable for any harm or loss resulting from the use of the internet network, such as in the case of hacking, occurrence of a Trojan horse or computer virus, that may occur despite our taking such measures to protect the security of your data. In order to secure your transaction and prevent fraud, SANA JARDIN will perform a payment card and anti-fraud check. By placing your order, you will be deemed to have authorized SANA JARDIN to perform such checks and, where SANA JARDIN deems necessary, from time to time to transmit or obtain information that you have provided to SANA JARDIN about you in order to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize a particular purchase transaction.

10. ACKNOWLEDGMENT OF ORDER
Once you have placed your order on the Website, you will receive an Acknowledgment of Order by email acknowledging the details of your order.

The Acknowledgment of Order will contain an Order Reference Number assigned by SANA JARDIN. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, SANA JARDIN will conduct its usual security and anti-fraud checks and then process your order.

11. CONFIRMATION OF ORDER BY SANA JARDIN
Upon shipment of the Products you have ordered, following completion by SANA JARDIN of its anti-fraud and security checks, SANA JARDIN will send you by email a written Confirmation of Order. The Confirmation of Order constitutes the acceptance of your order by SANA JARDIN and creates a binding sales contract.

In case of an order through the Customer Service the applicable Conditions of Sales will be attached to this confirmation email with a view to enabling you to read them, store them on a permanent medium. Carefully review them.

If you do not have an email address the main provisions of these Conditions of Sale will be attached to your invoice.

12. COMPLIMENTARY SERVICES
The following complimentary services may be proposed, free of charge, on the Website or by the Customer Service Centre:

12.1. Gift wrap, Gift Card and SANA JARDIN Box or special packaging

Packages may be delivered gift wrapped, with the complimentary SANA JARDIN Box or special packaging depending on their availability. The SANA JARDIN Box and special packaging may be valuable. In case you decide to return the Product, the Product should be returned in its original SANA JARDIN box or special packaging.

When estimating package delivery time, please allow time for credit approval, address verification and order processing. Once the order is processed and ready for dispatch, we will send you the Confirmation of Order by email. You will be sent a tracking number and the name of the carrier delivering your order so that you can track delivery status. We will use reasonable efforts to ensure the following estimated delivery lead times from the date of acceptance of your order:

• Mainland UK: 24 hours or 48 hours according to the postal authorities indicative delivery times.
• Non-mainland UK, Northern Ireland, Channel Islands: between 2 to 5 days according to the postal authorities or courier indicative delivery times.
• European Union: between 2 to 6 opening days according to the postal authorities or courier indicative delivery times.
• Rest of the world: delivery times vary according to each destination; they will be indicated for a particular country upon simple request.

* Saturday, Sunday and Public Holidays in the UK will not be considered as a regular business day with respect to estimated delivery time. Delivery on Saturday may however be proposed as a service to specific post codes by the Customer Service Centre. Please contact the Customer Service Centre for more information.

SANA JARDIN insures each purchase during the time it is in transit until it is delivered to you. We require a signature by a person who has reached the age of majority to confirm your acceptance of each Product delivered, at which point risk and responsibility for your purchased Products pass to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you understand and accept that evidence of a signature by such recipient (or at that delivery address) is evidence of delivery and fulfillment of the sale contract by SANA JARDIN and transfer of risk and responsibility to the recipient in the same way as if the Product had been delivered to you.

14. INVOICES
When ordering Products on the Website or through the Customer Service Centre, you, as the Customer, will receive an invoice with your product(s). The invoice will also be available in the "My Account" section on the Website, provided you are a registered Customer.

If you purchase a Product as a gift for a third person ("Gift Recipient"), the invoice will be sent to the email address indicated when purchasing and stored in the "My Account" section, provided you have registered an account. SANA JARDIN will never send the invoice and payment details to the Gift Recipient.

15. YOUR CANCELLATION RIGHTS AND RETURN POLICY
As a consumer you have a legal right to cancel a Contract (under the Consumer Protection (Distance Selling) Regulations 2000) during the period set out below in clause 15.1. If you change your mind or for any other reason you decide that you do not want to keep a Product during the period set out below in clause 15.1, you can notify us of your decision to cancel the Contract and receive a refund (in accordance with clause 15.4. Advice about your legal right to cancel the Contract is available from your local Citizens' Advice Bureau or Trading Standards office. This cancellation right does not apply in the case of any custom-made products or products which are personalised. Details of your legal right to cancel and an explanation of how to exercise may be also provided in the Confirmation of Order.

15.1. Return Period

The Customer is entitled to cancel the contract and unequivocally inform SANA JARDIN that she or he does not wish to keep a Product purchased on the Website or through the Customer Service Centre within fourteen (14) days as from the day the product is delivered, in accordance with applicable law and the terms and conditions set forth below. No returns will be accepted by SANA JARDIN after the Return Period.

15.2. Return Process

Before returning your products, please contact our customer care team at customercare@sanajardin.com to start your return process.

Products cannot be returned to an authorized SANA JARDIN dealer. Products that were not purchased on the Website or through the Customer Service Centre may NOT be returned to the SANA JARDIN Returns Department.


Moreover any opened product will not be reimbursed. Removal of the product’s cellophane wrapping will constitute the product having been opened.

SANA JARDIN is not responsible for the cost of returning the Product. You must take reasonable care to ensure that the Product is correctly addressed, adequately packaged, bears adequate postage and reaches SANA JARDIN safely and is not damaged or lost in transit. SANA JARDIN also recommends that you insure the Product against such risks of damage or loss up to the full price of the Product.

The Customer shall send back the Product to the SANA JARDIN Returns Department without undue delay and in any event not later than 14 (fourteen) days from the day on which he or she unequivocally informed SANA JARDIN that he or she does not want to keep the Product. Any failure to do so may delay any reimbursement that the Customer may be entitled to receive.

Any failure to return the original SANA JARDIN Box or special packaging in proper condition will entitle SANA JARDIN to withhold the corresponding value from such reimbursement.

We recommend the Customers to keep a proof of return shipment and SANA JARDIN accepts no liability in the event that such proof cannot be produced. Only merchandise received by the SANA JARDIN Returns Department will be eligible for a refund.

Upon receiving a return, SANA JARDIN will verify that the returned Product satisfies the conditions of the return policy and would then proceed with its reimbursement.

15.3. Returning a Product following Cancellation

The Products shall be returned in an unused state and in perfect condition, with all protective materials in place and tags and stickers attached to them subject to quality inspection and functional testing as defined below. You must take reasonable care of the Product when examining it. With regard to any deterioration of the Product, compensation is only due if the deterioration is caused by a use beyond the ordinary quality inspection and functional testing of the Product. "Quality inspection and functional testing" is understood to mean the testing of the Product as one would usually do in a retail outlet. Any failure to return the original SANA JARDIN Box or special packaging in proper condition will entitle SANA JARDIN to withhold the corresponding value from such refund.

As to perfumes, the product must not be open and must be returned in its original packaging. If the cellophane wrapping has been removed, the item will not be accepted for return or exchange.

All returns will be subject to strict Quality Control (QC) by SANA JARDIN  to ensure that the returned Product satisfies these requirements. If the Product does not meet QC standards, SANA JARDIN may claim damages from the Customer.

Customer shall be responsible for any loss of value of the Product due to manipulation thereof contrary to the principles of civil law, such as good faith or unjust enrichment. Accordingly, if the product is damaged or destroyed, SANA JARDIN will deduct the cost of repair or replacement of the refund amount.

If the returned product meets the quality control, SANA JARDIN will proceed with refund or apply for an exchange.

15.4. Refund

Should a Product be returned to the SANA JARDIN Returns Department, only a Customer will be entitled to receive a refund. In no event will a Gift Recipient be entitled to receive a refund.

Initial delivery charges will be refunded to the Customer.

The purchase price of the Product and the costs of its delivery to you will be refunded to Customer’s payment card no later than thirty (30) days of the day on which you communicated your decision to cancel the contract and return the Product to SANA JARDIN.

Faulty Product Refund Policy:
Upon delivery, if you notice any of the products in your order are damaged or faulty, we will happily replace them. To process this, we kindly request that you provide proof of the fault in the form of:
  • Photographic evidence: Clear photographs demonstrating the fault or damage.
  • Video evidence: A video that clearly shows the fault or malfunction.
Upon receiving and verifying the fault, we will happily provide you with a replacement for the faulty item. Steps to claim a refund for faulty products:
  1. Contact us via customercare@sanajardin.com with the evidence attached.
  2. Once we verify the fault, we will contact you to arrange a replacement item.



15.5. Exchange

Customer may be permitted to exchange a Product purchased on the Website or through the Customer Service Centre for another Product if the Product to be exchanged satisfies the conditions of the return policy.

SANA JARDIN will send an invoice to the Customer which specifies the value of the returned Product, the price of the Product for which the original Product has been exchanged and the difference to be paid by Customer or the amount that the Customer is entitled to receive, as indicated below.

Should a Product be returned for exchange to the SANA JARDIN Returns Department by the Customer, the original order will be cancelled and the Customer will be entitled to receive a refund of the price difference if the Product to be exchanged is more expensive than the desired Product or will be charged the price difference if the Product to be exchanged is less expensive than the desired Product. A new order will be placed in accordance with these Conditions of Sale with respect to the exchanged Product.

Delivery costs and lead times indicated in article 13 will be applied for this new delivery.

15.6. Legal warranty against hidden defects; Non-conforming Product

15.6.1 SANA JARDIN is extremely cautious in ensuring that each Product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

If nevertheless you or the Gift Recipient receive a Product which seems defective or are not as described on the Website (“Non-conforming Product”), you or the Gift Recipient may return it to SANA JARDIN as per the return process outlined above. Upon receipt, SANA JARDIN may classify the Product as a defective Product. Please note that Products that are damaged as a result of wear and tear are not considered to be defective.

Returning a presupposed defective Product can only be done in a 6 months period as from the date of delivery.

Beyond this 6 months period you will have to evidence that the Product was defective at the date it was delivered.

If SANA JARDIN concludes that the Product is a Non-conforming Product, you or the Gift Recipient, as applicable, may require SANA JARDIN to:
(i) Replace it with an identical Product, subject to availability;
(ii) Repair the Product (if such repair is commercially reasonable); or
(iii) Refund the full price of the Product to the Customer (not to the Gift Recipient).

For perfumes if a product is defective or has been damaged during delivery, the client must ensure that the bottle is still hermetically sealed and that the pump has NOT been initiated (if this is not the case, contact the Customer Service Department).

SANA JARDIN may also (but is not obliged to) offer to exchange the Non-conforming Product for another Product of equivalent value or of greater value (in the latter case, subject to the payment by the Customer of the price difference). Such exchange shall be made in accordance with the exchange rules of these Conditions of Sale.

If you or the Gift Recipient do not agree with SANA JARDIN’s conclusion as to whether the Product is a defective Product, SANA JARDIN may (but is not obliged to) carry out further independent testing and inspection. You or the Gift Recipient will be charged for this inspection if the inspector concludes that the Product was not defective.

This, however, does not affect your statutory rights.

16. REPAIR
For any repair inquiry, please contact our Customer Service Centre by emailing customercare@sanajardin.com.

17. ACCURACY OF PRICING, PRODUCT DESCRIPTION

Although SANA JARDIN endeavours to verify the accuracy of the published information on the website in the form of advertising or in a catalogue, or supplied by the customer services centre, it provides no warranty, express or implied, regarding the accuracy, reliability or completeness of such information. If the correct price of a product SANA JARDIN is higher than the price published on our website, then SANA JARDIN will contact the customer to obtain his instructions before shipping the order. If SANA JARDIN cannot get your instructions SANA JARDIN can reject the order and notify you of such rejection.

Although SANA JARDIN strives to ensure that descriptions, photographs or products graphics representation posted on the website or in a catalogue are as accurate as possible, SANA JARDIN does not guarantee that those or other content are free of errors, whether following an inaccuracy, omission, an obsolete element or for any other reason.

Accordingly, the sole remedy of the customer in the event of an error of this type is to return the product as indicated in our return policy.

18. FINAL PROVISIONS

Agreement. These Conditions of Sale (as amended from time to time), including policies incorporated herein, constitute the agreement between you and SANA JARDIN regarding your purchase of Products through the Customer Service Centre or the Website and supersedes any other agreement or understanding, arrangements, undertaking or proposal, written or oral, between you and SANA JARDIN in relation to such matters. In the event any other rules, code of conduct, or other matter posted on the Website conflicts with the terms of the Conditions of Sale, the Conditions of Sale shall govern. No oral explanation or oral information given by any party shall alter the interpretation of the Conditions of Sale.

Severability. In the event, that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.

Governing Law and Jurisdiction. These Conditions of Sale for the purchase of Products through our Webite or through the Customer Service Centre and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. We retain the right to bring proceedings against you in your country of residence or any other relevant country.

19. DELIVERY & RETURN
TERMS OF DELIVERY:

Articles will be delivered to the delivery address mentioned at the time of the order.

DELIVERY TIMES:

Articles are only shipped after the client’s effective payment. Delivery times are indicated below. Even though we shall endeavour to respect these delivery times as accurately as possible, they depend on transportation possibilities.

• Mainland UK: 24 hours or 48 hours according to the postal authorities indicative delivery times.

• Non-mainland UK, Northern Ireland, Channel Islands: between 2 to 5 days according to the postal authorities or courier indicative delivery times.

• European Union: between 2 to 6 opening days according to the postal authorities or courier indicative delivery times.

• Rest of the world: delivery times vary according to each destination; they will be indicated for a particular country upon simple request.

SHIPPING COSTS:

Shipping costs for an order of 5 articles at most amount to:
• Free Mainland UK Delivery with orders over £180. £6 for shipments in mainland UK for orders under £180,
• Free for all non-mainland UK, Northern Ireland, Channel Islands for orders over £180. £15 for shipments in non-mainland UK, Northern Ireland, Channel Islands for orders over £180
• Free European Delivery with orders over £180, excluding Lichtenstein, Norway and Switzerland. For orders below £180 please see table below.

    Customs & duties can be requested according to the regulation of each country.

    RETURNS

    RECEIPT OF GOODS:

    The client must verify the state of the delivered articles’ packaging and their compliance with the articles ordered.

    CLAIMS:

    Claims with respect to any obvious defect of the delivered articles or their non-compliance with the articles ordered or the shipment form’s statement must be submitted in written within eight (8) days as from the articles’ delivery.

    The client shall have to prove the reality of the observed defect or non-compliance. He/she shall grant to the seller the possibility to verify the actual existence of these defects and remedy them. The client shall neither attempt to remedy these defects personally nor have any third attempt to remedy them.

    If the claim is submitted within the aforementioned period of time, the articles that do not comply with the articles ordered or that are affected by an obvious defect shall be, at the client’s choice, either reimbursed or replaced, subject to the availability of similar articles.

    The refund of the delivered article or the delivery of the new article shall be executed within 30 days as from the receipt of the non-complying or defective articles to the following address: SANA JARDIN 25 Wilton Road London SW1V 1LW, UNITED KINGDOM.

    WITHDRAWAL RIGHT:

    In compliance with the provisions of the Consumer Code, the client may exercise his/her withdrawal right within seven (7) clear days as from the ordered articles’ receipt. In this case, the client does not have to justify his decision. He/she does not have to pay any penalty either.

    A client exercising his/her withdrawal right shall however bear the costs resulting from the ordered articles’ return and the related risks thereof. Articles shall then be returned to the following address: SANA JARDIN 25 Wilton Road London SW1V 1LW, UNITED KINGDOM. Articles must be returned in their packaging of origin. They must furthermore be sufficiently protected. Returned articles will be reimbursed by check or bank card credit within a maximal period of thirty (30) days as from the date of the articles’ receipt. Once the articles have been used, this withdrawal right may no longer be exercised.

     

    20. DISCOVERY SET VOUCHER:

    On completing a purchase of our Discovery Set, through the Sana Jardin online store exclusively,  you will be allocated a voucher code, which  will be sent to you via email. This voucher will be for the value of the Discovery Set and will be redeemable against any full size fragrance (50ml or 100ml fragrance) on the Sana Jardin website within 60 days of the Discovery Set initial purchase. Valid on full price items only. The voucher is not redeemable against the cost of a candle, kit, sample, set or rollerball and is not valid on any partner websites. The voucher cannot be used in conjunction with other offers.
